GENERAL CONDITIONS OF SALE: This document contains the general terms and conditions of sale for our website www.camasha.com . The parties agree that their relationship will be governed exclusively by these terms and conditions, excluding any conditions previously cited on the website or established by an authorized representative of our company.
VALIDATION OF ORDERS: All orders must comply with these general conditions of sale, as well as the prices and descriptions of the products sold. CAMASHA undertakes to ship the requested orders as long as they are in stock. If the item is out of stock, CAMASHA reserves the right to send the customer an alternative item with similar or superior characteristics and the same value, upon prior notice to the customer. In the case of a production order, CAMASHA will have a period of 15 business days to prepare the item for delivery. If this deadline is not met, the CUSTOMER will have the right to exchange the product or request a refund in the same form in which they made the purchase. Once the order has been shipped, the customer will receive a confirmation email.
PRICE OF PRODUCTS: The prices indicated on the website are valid for 10 days. Prices include order processing fees. The invoice sent to the customer will include the product prices and order processing fees. The prices shown are guaranteed within the limits of available stock, except in the case of significant changes in costs, including VAT, and subject to error or omission. Any promotion offered through discount vouchers will be valid for a specific period of time. CAMASHA reserves the right to change prices at any time.
TRANSPORTATION RATES: Unless otherwise specified, CAMASHA reserves the right to collaborate with the carrier of its choice. In any case, our company will not be responsible for any delays to orders, damage to packages, or lost packages.
PACKAGING: Unless otherwise specified, CAMASHA is solely responsible for its own packaging standards, depending on the selected shipping method. If a customer requests that CAMASHA package their order in a specific manner, the costs thereof will be borne by the customer.
PAYMENT METHODS: Discounts and promotional codes will only be applied to the total value of the items ordered. Under no circumstances will they be deducted from the shipping costs associated with the order. CAMASHA reserves the right to request advance payment from the customer or to request personal information necessary for secure payment. CAMASHA reserves the right to reject any order or delivery in the following cases: if there is a dispute with the buyer, if the payment does not comply with our terms and conditions, or if the bank denies authorization for payment via credit card.
CUSTOMS FEES: Unless otherwise provided, customs fees will be borne by THE CUSTOMER . These fees are NOT included in the item price. Furthermore, sometimes customs may hold a package for reasons beyond our control, so CAMASHA declines all responsibility for any additional fees that customs may require in these cases. The customer must decide whether to pay these fees or not in order to receive their order. In the event of not receiving it, CAMASHA does not apply the Money Back Guarantee.
IMPORT / EXPORT PERMIT: If the customer wishes to be reimbursed for any customs fees paid, they must be in possession of an import/export license. In this case, CAMASHA will provide a copy of the invoice with the necessary information to complete the process.
LOSSES AND DAMAGES: CAMASHA is not responsible for packages that have been lost or damaged in transit. In such a situation, the buyer should contact the shipping company responsible for shipping their order directly. If the customer decides to claim that the package was damaged before the carrier took charge of it, they must provide CAMASHA with an official document signed by the carrier, confirming that the package was collected by them in such condition.
RETURN CONDITIONS: Items may be returned within 30 days of receipt. Items with a sizing issue (the size received is different from the measurements indicated on the page) or quality issues may be returned free of charge, as well as under CAMASHA's GUARANTEE. Returns for any other reason will be the customer's responsibility. To minimize shipping costs, CAMASHA provides customers with an electronic return label upon request, the cost of which will be deducted from their refund. The cost of the label depends on the weight of the returned package ($150MX up to 1 kg, and $200 up to 2 kg for domestic shipments, and subject to a quote for international shipments). Items must be sent in their original packaging and in perfect condition, as received. The following items cannot be returned: socks, underwear, swimwear, jewelry, and accessories (with the exception of scarves, handbags, and blankets). CAMASHA reserves the right to deny refunds for items that do not comply with these terms of sale, as well as for products that were not received by the customer due to their absence or payment of the corresponding taxes on international shipments. Exchanges, returns, or refunds will not apply to products made to specific measurements or specifications unless the product does not meet the contracted measurement specifications; this is considered within the normal range of up to 1.5 cm (special workmanship).
CAUSES OF FORCE MAJEURE: CAMASHA shall not be liable under any circumstances for failure to comply with the obligations stipulated in these terms and conditions in the event of force majeure, such as natural disasters, fires, wars, strikes, riots, attacks, floods, inability to obtain raw materials, or under any circumstances beyond CAMASHA's control.
LEGAL FEES AND EXPENSES: The client agrees to indemnify CAMASHA against any claim or demand, including attorneys' fees, made by a third party as a result of or due to the violation of these terms and conditions.
RESPONSIBILITY: CAMASHA disclaims all liability for any loss or damage arising from the use of any of its items, individually or in combination with other items, after order acceptance. CAMASHA is not responsible for any error regarding the quantity of items delivered unless the customer informs CAMASHA within 30 days of delivery of the package, accompanied by an official document signed by the carrier stating that the package has been picked up in this condition. Delivery by the carrier is also shown, and it is the customer's responsibility to request insurance to ensure this.
WARRANTY: All products sold by CAMASHA are guaranteed to be free from defects in material and workmanship. All products are manufactured in accordance with applicable industry standards. This warranty is in lieu of and excludes any other warranties not expressly set forth herein, whether express or implied by law or otherwise, including, but not limited to, implied warranties of merchantability or fitness for a particular purpose. No agent, employee, or representative of CAMASHA is authorized to waive the terms of this warranty or to make any modifications, additions, representations, or warranties not included herein. You have 30 days from the date of delivery. WARRANTY PROCEDURE Complete the "Warranty Request" form at the branch where the product was purchased, along with the item covered by the warranty. Once the request is received at the branch, the item will be sent to the quality and customer service department within a period of no more than 24 hours, where a response will be given within a period of no more than 8 business days (this period does not include the time required to repair the item, if necessary). The response alternatives contemplated within our guarantee, once the Quality Auditor carries out the corresponding review, are: A) Repair: This is the first option in the event of a manufacturing defect. The delivery time for the product will be determined, and will not exceed 30 business days. Once the repair has been made, the customer must claim the item within a maximum of four (4) months after the product is available for delivery; after this period, the store will not be responsible. B) Exchange: The reference number that is the reason for the claim is replaced with another (this may be the same reference number or a different one with the same value paid). If the value of the new product is higher, the customer must pay the excess. Validity: Once the exchange is authorized, the customer has a 4-month deadline to make it effective. C) Denied: Denial of the exchange due to no quality problems or due to expiration of the warranty period.
RESOURCES AND LIMITATION OF LIABILITY: CAMASHA disclaims all liability for any direct or indirect loss, damage, or expense arising directly or indirectly from the sale, handling, or use of the items, or any other related cause. CAMASHA's liability is limited solely to the replacement of items that do not conform to this contract and to a refund of an amount equivalent to the purchase price of its items, even in the event of a claim related to a breach of this warranty. If CAMASHA requests the return of certain items, they must be returned in accordance with CAMASHA's established instructions. The remedies mentioned in this paragraph constitute the sole and exclusive remedies available to the buyer. CAMASHA undertakes to act in good faith to remedy any breach of liability.
BUYER RESPONSIBILITIES: The buyer represents that the items ordered are suitable for their intended use. Under no circumstances may CAMASHA's competence or judgment be questioned in the selection and/or design of the items displayed on www.CAMASHA.com . The buyer represents that the use of the items will comply with all applicable government requirements. To the extent permitted by applicable law, the customer agrees to indemnify and hold harmless CAMASHA, its group, its agents, its employees, its representatives, or any affiliated companies. This indemnification includes all costs (including legal fees) and damages arising from actual or claimed claims and penalties imposed by CAMASHA for any violation of any state law, regional regulation, or any other law.
LEGISLATION IN FORCE: This agreement and all matters related to its performance shall be construed in accordance with and governed by the law of Mexico City. Furthermore, the agreement shall be construed as a contract between merchants.
